Terms of Use

These terms are the agreement between you and Defiance Media LLC ("we," "us") for the Saudade app. By downloading or using Saudade, you agree to them.

1. Your license

We grant you a personal, non-transferable, non-exclusive license to use Saudade on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or redistribute the app.

2. What's free and what's paid

The daily line and sharing are free to use. A subscription unlocks keeping and underlining lines, journaling, choosing your own thread, and the full Book, including export.

3. Subscriptions and billing

• Saudade offers auto-renewing subscriptions: Monthly ($3.99) and Yearly ($24.99). Prices may vary by region and are shown in the app before you buy.
• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription anytime in your Apple ID account settings.
• Refunds are handled by Apple under the App Store terms; we can't issue them directly.
• If a subscription lapses, you keep the ability to read and export the writing you've already created — we will not lock you out of your own words.

4. The content

The lines in Saudade are drawn from public-domain sources and are presented for reflection. Saudade is not a source of medical, psychological, or mental-health advice, and nothing in it is a substitute for professional care.

5. Your writing is yours

Anything you write in Saudade belongs to you. It is stored on your device; we claim no ownership of it and do not receive it.

6. Acceptable use

Use Saudade lawfully and as intended. Don't attempt to disrupt, exploit, or gain unauthorized access to the app or its services.

7. Disclaimers

Saudade is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We don't warrant that the app will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of Saudade. Our total liability will not exceed the amount you paid for the app in the twelve months before the claim.

9. Changes

We may update the app or these terms. If we make material changes to these terms, we'll post the updated version here. Continued use after changes means you accept them.

10. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

11. Apple

• This agreement is between you and Defiance Media LLC only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any support or maintenance for the app.
• Apple is not responsible for any product warranties, whether express or implied.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
